Laws to protect owners of units
OWNERS of new apartments will be covered against shoddy building work by a defects bond to be paid by developers under new laws to come into effect next year.
The change will mean developers of highrise apartments will hold a two per cent bond against poor workmanship for two years after completion.
Strata legal experts welcomed the move but said two years was not long enough to uncover all defects.
“A lot of these problems don’t manifest themselves until a few years down the track and to think you have to identify them within two years is a bit much,” said property lawyer Stephen Partington.
The need for better protection for apartment buyers was highlighted by a University of NSW survey that found a staggering 85 per cent of new apartments built since 2000 had defects.
Minister for Better Regulation Victor Dominello said the high prevalence of defects in new strata developments was “concerning”.
“The defects bond will lift industry standards and protect consumers against poor workmanship,” he said.
He said the changes balanced the needs of consumers with minimising the cost burden on developers and aimed to reduce the number of disputes going to court.
The scheme, set to take effect in July 2016, will apply to apartments over three stories not covered by Home Builders Warranty Insurance. The bond would fund repairs such as water leaks, wall cracks and loose joinery.
In NSW, more than two million people live in strata apartments.
The new laws are part of a package of strata reforms that passed Parliament last week.
Public consultation on bylaws to accompany the reforms begins next year. |
