请问维州买公寓的合约

请问这里公寓过户的合约都写得这么硬吗? (屋龄10年已过保固)
基本上建商跟屋主是完全免责
有人说公寓过保固了就是这样,要修理就是靠基金,所以合约免责很正常,不知道各位怎么看

Acknowledgment of Condition
10.1 The Purchaser represents and warrants to the Vendor that, because of the Purchaser's own
inspection and enquiries, the Purchaser:
(a) is satisfied as to the nature, quality, condition and state of repair of the Property;
(b) accepts the Property as it is and subject to all defects (latent or patent) and all
dilapidation and infestation;
(c) is satisfied about the purposes for which the Property may be used and about all
restrictions and prohibitions on its development; and
(d) has full legal capacity and power to enter into this Contract.
10.2 The Purchaser may not make any objection, requisition, claim for compensation or damages,
delay the Settlement Date, rescind or terminate because of anything in connection with:
(a) any of the matters referred to in paragraph 1 of this Special Condition;
(b) loss, damage, dilapidation, infestation, defect (latent or patent) or mechanical
breakdown which may affect the Property, and which is not considered to be fair wear (c) the state of cleanliness or repair of the land or any improvements erected thereon;
(d) the roof or surface water drainage from the Property being connected to a sewerage
service; or
(e) there being or not being an easement or other right in respect of a service.

状况确认

10.1 买方向卖方声明并保证,由于买方自行进行的检查和调查,买方:

(a) 对物业的性质、品质、状况和维修状况感到满意;

(b) 接受物业的现状,并接受所有缺陷(包括潜在缺陷和显性缺陷)以及所有

破损和虫害;

(c) 对物业的用途及对其开发的所有限制和禁止感到满意;以及

(d) 具有订立本合约的完全法律行为能力和权力。


10.2 买方不得因下列任何原因提出任何异议、要求、赔偿或损害赔偿请求、延迟交割日期、撤销或终止本合约:

(a) 本特别条款第1款所述的任何事项;

(b) 可能影响该物业的损失、损坏、破败、虫害、缺陷(潜在或显性)或机械故障,且不属于正常损耗;(c) 土地或其上任何建筑物的清洁或维修状况;

(d) 该物业的屋顶或地表排水系统是否连接至污水处理系统;



(e) 是否存在与某项服务相关的地役权或其他权利。
