Chinese man jailed for strangling lover
Shortly after strangling his lover with his bare hands, Qinglin Chen placed her body in a bed and surrounded her with ice, a blanket and her favourite food.
Chen, a 31-year-old Chinese national, was sentenced in the NSW Supreme Court on Friday to a maximum of 23 years, 10 months for Wenfang Chi's murder.
The court was told the couple met and married in China, but had divorced "for the sake of appearances" because Ms Chi's parents were unhappy about the relationship.
On the night of September 29, 2007, after drinking red wine, Chen strangled Ms Chi at the home they shared at Rydalmere, in Sydney's west.
He put her body in his car, and drove to his other residence at Berala.
Chen then put Ms Chi in a bed, surrounding her with blankets, ice and her favourite food, in accordance with Chinese tradition.
Two days later, Chen handed himself in to police, and was charged with her murder.
He pleaded guilty to her manslaughter but this was not accepted by the crown, and on October 21 last year he was found guilty of murder.
In sentencing Chen to a minimum 17 years, six months, Justice Stephen Rothman said the motive for the crime was unclear.
"There are a number of possibilities," he told the court.
"It may be that Mr Chen could not stand the thought of Ms Chi returning to China, and at the insistence of her parents, involving herself in a relationship with another.
"It may be that Ms Chi acquiesced, or even promoted the action. We will never know."
Justice Rothman said there was debate about how drunk Chen was when the murder was committed, but rejected his statements to police about having no memory of the incident.
"He had the intent, at least, to inflict grievous bodily harm," he said.
"Mr Chen was not so drunk that he did not know what he was doing."
He said Chen suffered from psychosis but that did not completely explain his behaviour.
"(It) more probably than not affected his behaviour and his attitudes at the time of the offence," he said.
"I do not accept that he was experiencing a prodromal episode when he committed the murder."
He said Chen had been of good behaviour most of his life, and had a strong chance of rehabilitation.
With time already served, Chen will be eligible for parole in March 2025.
