据2008年12月18日《The Age》报道，今年年初墨尔本维多利亚大学华裔数学研究员曹中军博士在从大学回家的路上遭遇一伙年轻歹徒殴打抢劫致死案今天将在墨尔本宣判。

12月18日上周五，该案的其中两名被告在维州最高法院承认误杀曹博士以及抢劫他的财物。由于这两名被告属于未成年青少年，高院下达具体姓名禁制令，只能以BM和HW来代替。

今年1月22日晚，在墨尔本西区Footscray一家麦当劳餐厅，七名青少年在那里闲聊，有人提议专门去找印度人进行打劫。（go out "curry bashing", which meant assaulting and robbing an Indian.）于是这伙人驱车在街上游荡，寻找目标。

41岁的维大华裔数学研究员曹中军博士当时正从维大返家途中。在距离家门口仅500米的Empire Street，其中17岁的被告BM在曹博士脸上猛击了两拳，另一名17岁的被告HW还用力推搡曹博士，又有一名年龄最大的青少年更将曹博士推倒在人行道上，还用脚猛踢曹博士的头部，并抢走了曹博士的钱包和手机，钱包里只有$15元现金。随后，这伙青少年的三人又在另外一处地方毒打并抢劫另一名无辜的男子。

曹博士被殴严重受伤，后被送往医院，四天后抢救无效身亡。

上周五两名年轻被告出庭受审，他们的的代表律师向法官求情，表示两被告人对所作所为“深感悔恨”，并与当局合作态度良好，请求法庭判处他们在青少年管教中心而不要在成人监狱里服刑。

今年10月，本案中另外两名青少年被法庭裁定表面证供成立，等候宣判；今年7月，第五名青少年承认殴打并抢劫另一名无辜男子，法庭仅判他签持守良好行为18个月交保获释。

曹中军博士原为中国河南大学数学系讲师，1991年就读北京师范大学研究生，1997～98年曾在悉尼新南威尔士大学教育系任访问学者。2001年只身移居南澳首府阿德莱德，2002年夫人周女士和女儿曹晴来到澳洲和他团聚；2004年获得墨尔本Monash大学数学教育博士学位，2005年获得维多利亚大学Footscray校区助理研究员职位后单身一人到墨尔本来工作，和自己的家庭两地分居，太太和女儿仍留在阿德莱德，在遇难前的2007年由于学术研究成绩突出刚被提升为研究员。

曹博士的同事们记得他非常乐于助人，在维大广受欢迎。他又深深思念在南澳的亲人们，总是迫切期望去阿德莱德探亲。他个子不高，只有1米70左右，身材瘦削，却没想到遭此横祸，含冤而死，身后留下太太周静芳女士和16岁的女儿。。。

2月4日，周静芳女士接受了《Herald Sun》采访，该报以《Love that won't die》为题做了报道。周女士回忆了她与曹博士在上大学期间相识，1990年结婚，一年后他们有了女儿曹晴。她说曹博士热爱家庭，非常爱女儿，他们本是非常快乐幸福的家庭，没想到却遭此飞来横祸。

不过，周女士在接受《Herald Sun》采访时表示，尽管发生这么大的悲剧，她依然热爱澳大利亚。

曹博士被殴昏迷后离世的当天是澳洲国庆日，陆克文总理正在堪培拉主持当地的公民入籍仪式，他对来自世界各地的新移民说，“我想对你们说的只有一个词: Welcome。。。。”

然而，正是在那个下午，七年前满怀着新生活的希望和梦想，从中国移民到澳洲的曹博士却在距离家门口仅500米的街上被这群当地青少年活活打死，魂断异国他乡，含恨离世！

A GROUP of youths who went out "curry bashing" in January killed a Victoria University maths research fellow for his wallet and mobile phone.

Two of the youths, BM and HW, who cannot be named for legal reasons, pleaded guilty in the Supreme Court yesterday to one count each of manslaughter and robbery. HW pleaded guilty to a second count of robbery.

Prosecutor Chris Beale said seven friends met at a Footscray McDonald's store on January 22. BW and another youth had suggested the group go out "curry bashing", which meant assaulting and robbing an Indian.

He said the group left in cars to look for a target, and came across researcher Zhongjun Cao, 41, in Empire Street.

BM, then 17, punched Dr Cao twice in the face. HW, also 17, pushed him and another youth dropped him onto the footpath, Mr Beale said. As Dr Cao lay on the ground, the oldest member of the group kicked him "forcefully" in the head.

A co-offender stole Dr Cao's wallet and mobile phone before the group ran off. Later, three members of the group bashed and robbed a second man.

Dr Cao died four days later from head injuries.

HW and BM turned themselves in after hearing they were wanted for questioning.

Their lawyers said they had co-operated with authorities because they felt deep remorse. He requested that they be allowed to serve time in a youth facility, not an adult prison.

In October, two other youths were committed to stand trial over the attacks and a fifth youth pleaded guilty to the robbery of the second victim and was placed on an 18-month good behaviour bond in July.

HW and BM will be sentenced by Justice David Harper on Monday.

来澳十年，第一次参加葬礼，没想到是为了一位素昧平生的人，一位横死在街头的同胞，一位典型的中国知识分子。

早上挣扎着起来，9.45来到Tobin Brothers Funeral Service的停车场，只剩最后几个车位了。我心里嘀咕，这个停车场不大，难道没有多少人来参加吗？

来到大厅门前，有一位女士在分发别在胸前的小白花。大厅里有不少人在等候，推翻了我人不够多的疑惑和担心。当然有很多华人，但是也有不少其他各色人种，想来是曹博士生前的同事和朋友吧。室内哀乐低回，心一下子沉重起来。

大厅右边的一处追思室（是这么说吗？），并不顶大，座位很快坐满了。座位两边靠墙也站满了人，末排座位的后面也是一样。加上还有大厅里站立的看着同步电视的人，至少应该有200人左右。 不知道有多少是象我们这样的陌生人，只是来送这个同胞一程？

仪式开始了，很遗憾的觉得主持人选的不好，普通话和英语的口音都太重，我听的很吃力。特别让我感到不舒服的是，他连曹博士的姓氏都发错音。一共有5位上台发言，追悼曹博士的一生，包括维大的一位校董，中国领事馆的一位副领事，曹博士生前同一个team的同事，曹博士的生前好友，还有一位女士，代表曹博士的妻子周静芳女士。副领事杨玉明女士发言的时候泣不成声，中间几次中断，而最后一位女士，哽咽地朗读了周静芳女士写的发言稿，怀念了他们俩之间十七年婚姻里的互相扶持和关爱，表达了妻子对丈夫横死的震惊，悲伤和不能接受，更是让人肠断，座中满是压抑的低低的抽泣声。

发言完毕后，大家有秩序的排队，按照中国的习俗，到灵前为曹博士燃一炷香，并瞻仰遗容。棺木中的曹博士身材瘦小，看得出头部经过处理，但仍然绑着绷带，似还有血迹。难以想象亲人如何面对这样一幕？ 灵侧，站立着几位女性家属，包括曹博士的妻子和女儿。女儿已经16岁了，是个大人模样；周女士看上去也是知识分子样子，憔悴悲伤，但是无泪。我想她的泪早已流干了吧？

大厅外有一个捐款箱，还有一本留言簿。捐了自己的一点绵薄之力，想要留言，想了想，终究还是无言，遂离去了。

室外阳光灿烂，天上有几朵白云。路上车来车往，市声喧闹。可是这一切，都与曹博士无关了。而他的家人，他的至亲，又要花多少时间，来排解如此深重的悲伤？一生不知道够不够？

曹中军博士，一路走好，愿你在天堂得到安息。

The two men, BM and HW, who cannot be named for legal reasons, had pleaded guilty in the Supreme Court to one count each of manslaughter and robbery.

In court today, Justice David Harper sentenced BM to three years' detention in a youth justice centre for manslaughter and two months' detention for one count of robbery.

He will effectively spend two years in detention as he has already served one.

BM looked over at his father and smiled after the verdict was read out.

In sentencing today, Justice Harper said the two men were cowards who set upon a defenceless man walking home from work.

"His was a tragic death. In a sense it is easy to say this, because all life has inherent value, and every unnecessary death has at least an element of tragedy,'' Justice Harper said.

"But some deaths are more poignantly and inherently distressing than others, this was one such death.''

Justice Harper said Dr Cao's widow in a victim impact statement tendered last week, described her husband as her best friend and soul mate.

"Since his death, her life has been made burdensome by loneliness and fear,'' Justice Harper said.

HW and BM turned themselves in after hearing they were wanted for questioning.

在澳洲，乃至西方国家中，该判决结果并不出人意料，根据刑法原则，对某一被诉罪处三年以上（包括三年）自由刑即为重刑，我不知道凶手是被DPP以多项重罪还是以单一罪起诉，如以多项重罪起诉并被陪审团裁定成立，则量刑不应如此畸轻，即使达成控辩交易，但如只以一罪起诉，同时又与控方达成控辩交易，则控方可能转以相对轻罪起诉，就可能出现这个结果，凶手的年龄倒不是法定的减责因素。总之，澳洲在一定意义上说是严重作奸犯科者的天堂。

TWO teenagers who were part of a vicious gang that kicked a man to death for fun will only spend around two years in youth detention.

In the Supreme Court today Justice David Harper said the attack on Dr Zhongjun Cao, 41, took place during "several hours of mad, senseless criminality".

He said the two youths, who are both 18 and can only be named as MBA and WH, set out with six others to find, attack and rob an innocent victim in Footscray in January this year.

"You both agreed to be part of a gang, the aim of which was seriously criminal," Justice Harper said.

"You did not want or expect that anyone would die as a result. Robbery involves the use of force, or at least the threat of it.

"You were prepared to be involved in that."

Dr Cao, a research fellow at Victoria University of Technology was on his way home when he was confronted by the gang at the intersection of Kinnear and Eldridge Streets.

Justice Harper said he was punched and then flung to the ground, hitting his head on the pavement.

As he lay stricken another member of the gang kicked him in the head and then his wallet and phone were stolen.

The father of one died four days later in hospital.

“Partly out of a totally misguided sense of entertainment, and partly because members of your pack wanted to steal Dr Cao’s mobile phone, he was set upon by you and your friends,” the judge told the two teenage killers.

Justice Harper said WH went with some members of the gang they and later attacked another man, Binesh Mosaheb, who was walking home after catching the last train to Sunshine.

Mr Mosaheb was picked on because he looked Indian although he was in fact from Mauritius.

The judge said this demonstrated "the mindless ugliness of racism".

WH was born in China and MBA came from a migrant family and was dark skinned.

Mr Mosaheb was punched and flung to the ground and had his mobile phone and backpack stolen. He receovered from his injuries.

MBA pleaded guilty to one count of manslaughter and one count of robbery and he was sent to a Youth Justice Centre for three years but with time already served on remand he will be out in just over two years.

MBA smiled broadly after the sentence was pronounced.

WH pleaded guilty to one count of manslaughter and two counts of robbery and he was sent to a Youth Justice Centre for two years and eight months.

With time spent on remand he will be out in just less than two years.

Justice Harper said both teenagers came from good families, had no previous convictions and had good prospects of rehabilitation.

谢谢铁马兄弟的指点。如果依照法律并不出格，那么我们只有接受。 只希望这帮小孩能够真正知道自己做错了，同时希望大家保护好自己。

另外一个帖子中提到：“ WH was born in China and MBA came from a migrant family and was dark skinned.”， 似乎两个罪犯里有一个是出生在中国，有更详细的信息吗？

我只是真不敢相信一个来自中国的小孩能对一个中国人下这样的毒手。

另外文中提到这个团伙有还有其他人，不知道判决结果什么出来。 也许这两个只是小喽罗。
