A POPULAR Melbourne Chinatown restaurant that served a cockroach cooked in fried rice has been fined $20,000 without conviction.
A woman began eating the takeaway fried rice with chicken and cashews from the Westlake restaurant and remarked that it tasted "disgusting". "There's something crunchy in this," she said before removing a mouthful revealing legs and head of a bug.
The Melbourne Magistrates Court was told yesterday that the woman's mother, who had ordered the meal on October 23 last year, saw a "partially consumed cockroach" in the rice.
Sebastian Reid, prosecuting, said City of Melbourne investigators found numerous examples of poor food storage, accumulation of food waste, slime, mould and evidence of pests the next day.
Mr Reid said the kitchen floor had accumulated food waste, live cockroaches and cigarette butts.
Inspectors later found that some areas of ordered improvements had not been resolved.
Mr Reid said that Kan Chiu Chan, a director of the restaurant company, told investigators there had been a "cockroach problem" two weeks before the inspection.
Westlake Restaurant Pty Ltd pleaded guilty to charges that included failing to properly store food and supplying food not of the nature and substance demanded by the purchaser.
Defence lawyer Stan Waites said Westlake, which had no prior convictions in 24 years and cooks about 42,000 meals annually, had this month received "the all-clear" from inspectors.
He said the dead cockroaches in photographs had been "bombed" by a pest controller days before the inspection. He said the charges had caused "an enormous shake-up" at the restaurant, including the hiring of specific cleaning staff.
Magistrate Phillip Goldberg said consumers were entitled to expect hygienic food, but that the company had reacted positively and could rely on its previously good history to avoid a conviction
